United States Forest Paonia P.O. Box 1030
USDA Department of Service Ranger District N Rio Grande Ave.
Agriculture PHONE NO. 970-527-4131 Paonia, CO 81428
FAX 970-5274151
File Code: 2820-4
Date: December 1, 2008
RECEIVED
Joe Dudash
CDRMS
1313 Sherman St. Rm 215
Denver, CO 80203
DEC 0 5 2008
Division of Reclamation,
Mining and Safety
Dear
The_Paonia.,Ranger-District has-finished its-review-of Bowie_Resources,..MR-92, for-an
emergency gob-vent borehole. In accordance with procedures outlined in 30 CFR 906.30,
Appendix B, the Forest Service reviewed the Revision for post-mining land use consistency with
land use plan (GMUG Forest Plan), and the adequacy of measures to protect non-mineral
surface resources, as proposed by Bowie in their application.
The activities proposed in MR-92 are consistent with the activities previously approved in
Bowie's TR-52 (thirteen boreholes). As the activity proposed in MR-92 is coincident with
surface disturbances approved in TR-52 (no new surface disturbing activities are proposed), the
previously sent Conditions of Surface Use for TR-52 should be applied to MR-92.
Provided that the application is not further modified, and the previously sent Conditions of
Surface Use are carried forward in the DRMS' decision, this letter constitutes USFS
consent/concurrence to the decision.
Also, the FS requests that the future project related documents (e.g. decision and public
notices) DRMS acknowledge that protections for non-mineral resources brought forward by the
GMUG as the land management agency are included in the DRMS decision / documentation.
If you have any questions or concerns, please contact Ryan Taylor of my minerals staff at 970-
527-4131, or via email at rztayor a.fs.fed.us .
Sincerely,
LOREN PAULSON
Acting District Ranger
cc: Bill Bear
Caring for the Land and Serving People Printed on Recyded Paper "41
