In accordance with procedures outlined in 30 CFR 906.30, Appendix B, the Forest Service reviewed the Revision for post-mining land use consistency with land use plan (GMUG Forest Plan), and the adequacy of measures to protect non-mineral surface resources, as proposed by Bowie in their application. The activities proposed in MR-92 are consistent with the activities previously approved in Bowie's TR-52 (thirteen boreholes). As the activity proposed in MR-92 is coincident with surface disturbances approved in TR-52 (no new surface disturbing activities are proposed), the previously sent Conditions of Surface Use for TR-52 should be applied to MR-92. Provided that the application is not further modified, and the previously sent Conditions of Surface Use are carried forward in the DRMS' decision, this letter constitutes USFS consent/concurrence to the decision. Also, the FS requests that the future project related documents (e.g. decision and public notices) DRMS acknowledge that protections for non-mineral resources brought forward by the GMUG as the land management agency are included in the DRMS decision / documentation.
