Introduction <br />Purpose and Scope of this Document <br />The Colorado Division of Reclamation, Mining and Safety (the Division) received an <br />application, on November 26, 2007, from Hayden Gulch Terminal, Inc. (HGTI, or the applicant) <br />to renew permit C-1992-081 for conducting surface coal mining and reclamation operations at <br />the Hayden Gulch Loadout (the Loadout). The application number is RN-03. <br />Prior to deciding whether or not to approve a permit renewal application, the Division is required <br />by law to make specific written findings. Those findings are required by Section 34-33-114 of <br />the Colorado Surface Coal Mining Reclamation Act (the Act) and Section 2.07.6(2) of the <br />Regulations of the Colorado Mined Land Reclamation Board for Coal Mining (the Rules). This <br />document presents those findings and the Division's proposed decision regarding approval of <br />HGTI's permit renewal application. This document also contains a description of the <br />environment affected by the operation and summaries of the mining operation and reclamation <br />plans. <br />Replacement of Previous Findings Documents <br />This findings document replaces the prior findings document from the review of HGTI's original <br />permit application, Permit Renewal No. 1 and Permit Renewal No. 2. Much of the information <br />in this document is derived from these previous documents. <br />Information Sources for Permit and Review Process <br />The review process for permit revisions and renewals is described in the Colorado Surface Coal <br />Mining Reclamation Act (C.R.S. 34-33-101 et seq.) and the Regulations of the Colorado Mined <br />Land Reclamation Board for Coal Mining. Specific information about HGTI's mining and <br />reclamation operations can be found in the permit application and permit revision applications on <br />file with the Division of Reclamation, Mining and Safety, 1313 Sherman Street, Room 215, <br />Denver, Colorado 80203. <br />1
