16. The Division has contacted the Office of Surface Mining, Reclamation Fees Branch. As of <br />December 2, 2008, the operator is current in the payment of reclamation fees required by 30 <br />CFR Chapter VII, subchapter R. (2.07.6(2)(0)). <br />SECTION R <br />The following specific approvals are required by Rule 4: <br />1. ROADS - RULE 4.03 <br />Information on roads is presented in Volume 2, Tab 12 and Exhibit 12-1 of the permit <br />application. Roads inside the permit area are: 4,061 linear feet of haul road (HGLF-HR1), <br />one access road (HGLF-AR1), and one light-use road. Truck Loop Haul Road (HGLF- <br />HR2) is approved to be constructed in support of "load in" facilities. HGLF-HR1A was <br />identified in aerial photographs in 2005 and included in the permit; however, HGTI has no <br />design or construction detail for this existing light-use road. <br />The railroad spur is approximately 3.3 miles long and begins 0.3 miles from the town of <br />Hayden. The spur serves as a connection to the existing Denver and Rio Grande Railroad <br />(see Exhibit 12-1, "Facilities Map"). All roads will be reclaimed to approved post-mining <br />topography and revegetated unless: retention of a road is approved as part of the approved <br />post-mining land use, the road complies with all applicable performance standards, and <br />the landowner requests in writing to the Division that the road (or a segment of it) is to be <br />left open for further use. <br />II. SUPPORT FACILITIES - Rule 4.04 <br />Information on mine support facilities is found in Volume 2, Tab 12 of the permit <br />application. A summary is found in the Summary Section of this document under <br />"Description of Operations and Reclamation Plan." <br />III. HYDROLOGIC BALANCE - RULE 4.05 <br />A. Water Quality Standards and Effluent Limitations <br />Receiving stream standards for the Yampa River and its, tributaries have been set by <br />the Colorado Department of Health in their publication, "Classification and Numeric <br />Standards for Upper Colorado River Basin and North Platte River (Planning <br />Region)". Dry Creek is within segment 12 of the Upper Colorado River sub-basin <br />and basin. Colorado Department of Public Health and Environment NPDES <br />(National Pollutant Discharge and Elimination System) limitations on discharge and <br />the Division's standards for determining material damage to the hydrologic balance <br />("Division Procedures for the Assessment of Material Damage with Respect to <br />15
