Cattany <br />Jodi Villa Division Director <br />Kennedy/Jerks Consultants Natural Resource Trustee <br />143 Union Boulevard, Suite 600 <br />Lakewood, CO 80228 <br />RE: St. Vrain Lakes Filing 1 Slurry Wall; DRMS File No. M-1982-015; Receipt of <br />Request for a Full Performance and Financial Warranty Release <br />Dear Ms. Villa, <br />On December 3, 2008, the Division of Reclamation, Mining and Safety received your <br />request for a full release of the performance and financial warranty for the St. Vrain <br />Lakes Filing 1 Slurry Wall, File No. M-1982-015. Preliminary review of the information <br />received determined that the following items must be received before the Division can <br />consider release of the permit: <br />4.17 Release of Performance and Financial Warranties for Mining Operations <br />Rule 4.17.1(3) requires that the written notice requesting release be sent by <br />Certified Mail. Please resubmit the request using-Certified Mail. <br />2. Rule 4.17.1(4) requires that the notice contain a signed statement by the Operator <br />or their agent that all applicable portions of the Reclamation Plan requirements <br />have been satisfied in accordance with the Rules and all applicable requirements <br />under the Act. <br />Upon receipt of the above items, the Division will schedule an inspection of the lands <br />where mining activities occurred. If the Office finds the reclamation satisfactory, the <br />Office shall release the applicable Performance and Financial Warranties.
