2.05.5 Post Mining Land Uses <br />(2) After the reclamation activities described in Section 2.05.4, Tab Section <br />14 are completed, most of the lands affected by surface operations and <br />facilities within the permit area will have been returned to their original pre- <br />mining condition, which, as described in Section 2.04.3, Tab Section 4, <br />was "fish and wildlife habitat" according to Rule 1.04(71)(h). <br />The South Portal, including the top of the Roadside Refuse Disposal Area <br />was converted to commercial use (PR-3) for a fruit storage, packing and <br />retail sales location, and is now owned by Providence Place Inc. (PPI). <br />Since 2005 PPI has been using the warehouse & shop on the upper level <br />as equipment & material storage, the lab building is being used as the <br />sales location, the cafeteria on the lower level houses a refrigeration unit <br />and package area, and the block lab building on the lower level is used for <br />material storage. The South Portal is zoned as Agricultural Forestry <br />Transitional (AFT) by the Mesa County Department of Planning and <br />Development. Although the use of the property by Providence Place Inc. <br />is approved under the AFT zoning, Mesa County required a minor site <br />plan approval due to changes and upgrades that were planned for the <br />buildings on the lower level. Appendix 15-1 shows the minor site plan and <br />approval by the Mesa County Department of Planning and Development. <br />The Overland Conveyor south of 19/10 road will be converted to industrial <br />use for the Union Pacific Railroad (UPRR) and Xcel Energy. Xcel's haul <br />road, which is located on their property and being used for coal deliveries, <br />is located in the NE section of this area. Since completion of reclamation <br />and revegetation of the Overland Conveyor in 2004, the UPRR's <br />employees and contractors, with no consideration to SCC's revegetation <br />attempts, also continue to use this area for access to the rail for <br />maintenance and to store materials and equipment when repair jobs are <br />being performed. Taking into consideration that all the disturbed and <br />reclaimed areas are on UPRR's property, that Xcel will continue to use <br />their haul road, and that the area was classified as industrial prior to <br />mining, we believe that the postmining use of industrial is appropriate. <br />Exhibit 62 shows the pre-mining land use within the affected and adjacent <br />area. Exhibit 63 shows the post-mining land use. <br />With the exception of the Colorado Division of Reclamation, Mining and <br />Safety and the Mesa County Department of Planning and Development, <br />no other state or local agencies' authorizations are required to achieve the <br />post-mining land use described above. <br />TR-57 15-1 (Rev.07/08) <br />
