Boxl91 Natural Resource Trustee <br />Victor, CO 80860-0191 <br />Re: Cresson Project, Amendment Approval, Permit No. M-1980-244, Revision No. AM-9 <br />Dear Mr. Newcomer: <br />On December 3, 2008 the Division of Reclamation, Mining and Safety approved the Amendment application submitted <br />to the Division on April 28, 2008, addressing the following: <br />1) Add additional mining areas associated with the Main Cresson Mine, the WHEX area of the East Cresson Mine, and <br />the North Cresson Mine to include expansion of the Schist Island mine area and re-mining of the Globe Hill Deposit. <br />2) Haul Road to connect the new mining areas, Load out Bin, and the Phase V of the VLF. <br />3) An ECOSA and an extension to the SGOSA (East Cresson and Squaw Gulch overburden storage areas) <br />4) A Phase V extension to the VLF to Arequa Gulch and appropriate modification of the drainage and storm water <br />management plan to Arequa Gulch to accommodate the extension. <br />5) An increase in the placement of ore on portions of Phase I-IV of the existing VLF, from approximately 590 feet above <br />liner system to a height of approximately 800 feet. <br />6) Add a modified enrichment circuit to recalculate leach solutions more efficiently to load leach solutions with gold. <br />7) Change of the fuel and crusher supply access route from Areqau Gulch to a new access from the Ironclad area to the <br />crusher area. <br />8) The Coblentz geology building to be rebuilt near the Ajax head frame and the crusher facilities to be relocated to an <br />area near the secondary crusher building. <br />9) Incorporate M-1991-134 9 the Cameron Mine into permit # M-1980-244 (Cresson Project). Details of the amendment <br />application can be found in the seven volumes submitted to the DRMS on April 15,2008. <br />The terms of the Amendment No. 9 approved by the Division are hereby incorporated into Permit No. M-1980-244. <br />The DRMS Director signed and approved the Amendment application with conditions on November 10th 2008. The <br />conditions are attached with this approval letter . Please note that all other provisions of Permit No. M-1980-244 remain <br />in full force and effect. <br />The revised estimated liability amount of $98,994,665.00 surety exceeds the required surety performance bond currently <br />held. CC&V and DRMS have agreed to post the additional warranty, in the amount of $54,280,734 in phases and <br />consistent with CRS 34-32-117(4)(b)(1). The First phase, which is the construction phase in the Amount of <br />$36,594,665.00, will be posted with in 60 days or by February 4th 2009. The second Phase in the amount of $ <br />17,686,069 will be posted once the Phase V valley leach facility is constructed and certified and prior to loading <br />ore, in the year 2011.
