Cattany <br />Division Director <br />Natural Resource Trustee <br />Re: Yankee Gulch Minerals Project, File No. M-1999-002, Receipt of Designated Mining Regular (112d) <br />Operation Amendment 01 (AM-01) Reclamation Permit Application Package <br />a' <br />Dear Mr. Wilson: <br />On January 22, 2008, the Division of Reclamation, Mining and Safety received your revised 112d Amendment 01 (AM- <br />01) Reclamation Permit Application Form for the Yankee Gulch Minerals Project, File No.M-1999-002. Preliminary <br />review of the information received determined that the following items must be received before the Division 65n -consider <br />your application as being submitted and technical review can begin: <br />APPLICATION FORM: <br />o The first page of the application form, the Operator has omitted a comma in the company name. Please <br />revise the page to add a comma in between "Soda" and "L.L.P" as noted on the Secretary of States page. <br />o On page one of the application form, the operator noted -26.10 acres to be removed from the permit area. <br />Please be reminded that the purpose of this AM-01 is to change a portion of the site from rangeland to <br />industrial. The acreage reduction of the site will need to be sent under separate cover by certified mail <br />and will be processed as a separate action. <br />o On the signature page (page 8 of the application form), the Applicant/Operator name was not filled in. <br />This line will need to be filled in as "American Soda, L.L.P." <br />o The notary acknowledged Todd Wilson as Plant Manager of Solvay. A representative of American <br />Soda, L.L.C. will need to sign the form and be notarized under American Soda, L.L.P. <br />Your application will not be considered submitted until the information listed above is received and found sufficient to <br />begin our review. A decision date will be established 90 days from the date of receipt of all of the requested information. <br />Additionally, if you have already published notice you will need to republish notice, after the Division considers the <br />application submitted. This notice must be published once a week for four (4) consecutive weeks, starting within ten (10) <br />days of the date your application is considered submitted. We will notify you when you should initiate republication of <br />your notice. The final date for receiving comments is the 20th day after the fourth publication or the next regular <br />business day. <br />You have sixty (60) days from the above date to submit all necessary documents that the Office needs for an application <br />to be considered filed.
