Cattany <br />Division Director <br />Natural Resource Trustee <br />Carbondale, CO 1623 <br />Re: Blue Pit, 112c Application No. M-1981-207, TR-06 Preliminary Adequacy Review. <br />Dear Mr. Roberts: <br />The Division of Reclamation, Mining and Safety has reviewed the materials submitted for Technical Revision no. <br />6 and has begun the review process for the above referenced 112c Technical Revision application. The project <br />appears to be a straight forward request to move the concrete plant to the east end of the permit area. A review of <br />the application has only a few minor clarifications and issues to address. <br />1) The construction of the concrete plant may hinder the ability to reclaim the high wall to the proposed <br />2.5H:1 V that is required in the reclamation plan. Please provide a revised reclamation plan that accounts for <br />the proposed concrete plant and include a reclamation plan map that shows final reclaimed slopes with <br />contours. Please detail any proposed retaining walls and plant layout after reclamation has been completed. <br />2) Please submit documents that prove that Garfield County approves of the concrete plant to remain beyond <br />the permit. <br />3) The Division will require a notarized letter from the land owner stating that the concrete plant remaining <br />beyond the life of the mine is allowable. <br />4) Please provide a mine map that details the current contour lines present on the site. DRMS needs to conduct a <br />bond update and an accurate map of current mine conditions will assist in the bond calculation. <br />5) The current post mine land use is stated in the permit as wildlife habitat and open space. A permanent <br />concrete plant will require an amendment to change the post mine land use to be industrial. If the operator <br />still wishes to propose the concrete plant as a permanent structure please submit an amendment application <br />with all required notices, applicable amended exhibits, maps and updated reclamation costs. <br />This is a preliminary review. Other issues may arise from other agency comments, a site inspection and as more <br />information is supplied. The decision date for this application has been extended and set for January 18, 2008. <br />Judging by the issues brought up in this letter, the requested extension will not allow adequate time for staff <br />review.
