Cattany <br />Division Director <br />RE: Connell Resources, Inc., Wellington Downs Pit; Permit No. M-1995-035 Natural Resource Trustee <br />,/ R-02; Adequacy Letter #2 <br /> <br />Dear Ms. Bauer, <br />The Division received your response to the Division's adequacy letter of October 19, 2007 for <br />Technical Revision 02 (TR-02) for the Wellington Downs Pit; Permit No. M-1995-035 operated by <br />Connell Resources, Inc. ("Connell"). The Division has one remaining comment that needs to be <br />addressed prior to approval of the revision. <br />Connell is proposing to leave an asphalt pad on site. The operator will need to provide a more <br />detailed map of the location, dimensions and condition of the asphalt pad. The Division recollects <br />from a 2006 inspection that the condition of the asphalt pad is cracked and in need of repair. <br />Without repairs or reclamation of the pad, the area will be prone to weed infestations and further <br />deteriorate making the pad unusable. In addition, Section 34-32.5-116(4)(a) of the Colorado Land <br />Reclamation Act for the Extraction of Construction Material states that grading shall be carried on so <br />to create a final topography appropriate to the final post-extraction land use selected. Please further <br />explain how leaving the asphalt pad on site will remain in good condition and conform to the <br />approved reclamation plan of developed water resources. <br />Please be advised that Division's decision due date is set for November 30, 2007. If you feel more <br />time is needed to complete your reply, the Division can grant an extension to the decision date. This <br />will be done upon receipt of a written waiver of your right to a decision by November 30, 2007 and <br />request for additional time. This must be received no later than the deadline date.
