Mr. Andy Rodriguez, P.E. <br />December 2, 2008 <br />Page 3 <br />Well Name Hall Irwin LFH 64750-F <br />Relevant Well Permit 64750-F <br />Well Location NE %, NE %, SE %, SEC 36, T1 N, R67W, 6TH PM <br />Aquifer Laramie-Fox Hills <br />Allowable AF Amount 43.5 AF <br />Maximum Pumping Rate 100 gpm <br />The well is currently permitted for industrial, commercial and augmentation use. The <br />Applicant's accounting includes the 2% relinquishment requirement for the nontributary <br />Laramie-Fox Hills water. <br />In addition to replacing depletions resulting from this mining operation, the Laramie-Fox <br />Hills aquifer water will also be used by the Applicant to replace 12.15 acre-feet of depletions <br />resulting from operations at the Parker-Dersham site in accordance with the C.R.S. 37-92- <br />308(11) SWSP approved for Hall-Irwin. Since the Laramie-Fox Hills water is being used as a <br />replacement source for both plans, the applicant's accounting for each SWSP must specify the <br />total amount of Laramie-Fox Hills water released and the amount associated with each SWSP. <br />A monthly breakdown of depletions and replacements is shown in attached Table 3. <br />Conditions of Approval <br />I approve the proposed substitute water supply plan in accordance with Section 37-90- <br />137(11), C.R.S., subject to the following conditions: <br />1. This SWSP shall be valid for the period of January 1, 2009 through December 31, 2009, <br />unless otherwise revoked, modified, or superceded by decree. If this plan will not be <br />made absolute by a water court action by the plan's expiration date, a renewal request <br />must be submitted to this office with the statutory fee (currently $257) by November 15, <br />2009. <br />2. Well permit no. 66959-F (WDID 0203017) was obtained for the current use and exposed <br />pond surface area of the gravel pit pond in accordance with §37-90-137(2) and (11), <br />C.R.S. <br />3. The total surface area of the groundwater exposed at the Baseline Pit must not exceed 7.6 <br />acres (0.46 acres in the dewatering trenches and 7.18 in the settling ponds) during the <br />approval period of this SWSP resulting in an annual evaporative loss of 22.38 acre-feet. <br />4. The annual amount of water used for dust control shall not exceed 1.66 acre-feet, the total <br />product mined shall not exceed 380,250 tons per year below the groundwater surface <br />resulting in 11.19 acre-feet of water lost with the product, and the annual amount used for <br />concrete batching of 92,000 yards of concrete shall not exceed 11.29 acre-feet . <br />5. Total consumption at the Baseline Pit must not exceed the aforementioned amounts <br />unless an amendment is made to this plan.
