III. COMMENTS -COMPLIANCE <br /> Below are comments on the inspection. The comments include discussion of observations made <br /> during the inspection. Comments also describe any enforcement actions taken during the inspection <br /> and the facts or evidence supporting the enforcement action. <br /> This partial inspection of the King Coal Mine was conducted by DRMS staff from the Durango Office, <br /> located at 691 County Road 233, Suite A 2, Durango, CO 81301, phone (970) 247-5469. Operations <br /> were active at the King Coal 1 and 2 mines during the time of the inspection. The sediment <br /> containment systems appeared well maintained and functioning in accordance with design. Evidence <br /> of affected area drainage escaping the permit area prior to treatment was not observed. Five photos <br /> accompany this report. <br /> King Coal 1 Mine <br /> The three sediment sumps,designed to treat road drainage located outside of the sediment pond <br /> containment area, appeared well maintained and functional. The drainage swale in the entrance road, <br /> which directs yard drainage to the east sediment pond, was intact. The Operator has constructed a <br /> safety berm around the east pond and installed a culvert through the safety berm to convey yard <br /> drainage to the pond. <br /> The east and west sediment ponds have been recently cleaned of sediment. Both were holding water, <br /> visually estimated at one foot depth and well below,discharge levels; no discharge was observed from <br /> either pond. The primary and secondary spillways for the east pond were clear and functional, as <br /> were the primary spillway for the west pond and the overflow pipe from the west pond to the east <br /> pond. However, as shown in the photos,the secondary spillway for the west pond needs clean-out to <br /> ensure its continued function in accordance with its approved design. <br /> The ugly buggy, previously identified in the Division's report generated from the June 4, 2008 <br /> inspection as a possible obstruction to the inlet of a culvert, had been removed and the culvert inlet <br /> fully cleared. <br /> As shown in the photos, the Operator was extending the French drain for the refuse disposal pile and <br /> has cleaned sediment from the east upland diversion ditch located nearby the refuse disposal pile. <br /> Excavation of the easternmost portion of the refuse disposal pile, necessary for extension of the <br /> French drain, has temporarily disrupted the surface of the refuse disposal pile. However, the Operator <br /> has maintained surface grading of the refuse disposal pile to ensure positive drainage; evidence of <br /> impounded drainage on the refuse disposal pile was not observed. <br /> King Coal 2 Mine <br /> Ditches for the sediment containment system appeared well maintained and functional. The sediment <br /> pond was dry. Topsoil has been salvaged and stockpiled at the north end of the yard area. <br />
