Cattany <br />11541 Warrington Court Division Director <br />Parker, CO 81501 Natural Resource Trustee <br />Re: Tri-County Gravel, Permit No. M-1977-205, Technical Revision No. 2 Preliminary Adequacy Review <br />Dear Mr. Lewicki: <br />On October 18, 2007 the Colorado Division of Reclamation, Mining and Safety (DRMS) received Tri County Gravel's <br />request for a technical revision to Permit No. M-1977-205 addressing revisions to the mine phasing sequence, the change to <br />dry mining with 2:1 slopes, the installation of a sediment pond, and the design and construction of a new dike between Phase <br />1 and the Gunnison River including a new outlet structure for the pit lake. This revision cannot be approved until the <br />following issues are adequately addressed. Please submit a response to the following issues as soon as possible, but no <br />later than November 19, 2007 so the decision due date set for November 19, 2007 can be met. If your response or a <br />written extension request are not received by that date, this application may be denied <br />ADEOUACY COMMENTS <br />CA N" :'.<t "':. 1. The revised reclamation plan includes the end of some roads that are cut off by the excavation so they are isolated. <br />Please revise the reclamation plan, reclamation cost estimate and reclamation maps to either reclaim these sections <br />of road or re-connect them to permanent road features. <br />2. The proposed plan separates the old Phase V into two separate wetlands to be preserved. The area between these <br />two wetlands is proposed to be excavated, leaving an irrigation ditch at the crest of the pit slope. This scenario may <br />lead to unstable pit slopes in this location and could funnel water away from portions of the wetlands. DRMS <br />recommends leaving the current Phase V intact in it's entirety as a wildlife area. <br />3. The operator has committed to supplying water to the Phase V wetlands to maintain them during mining. This is <br />simple when the operator and the landowner with water rights are one in the same. However, this may be <br />problematic if the mining permit is transferred to another operator who does not control those water rights. Please <br />address this issue as necessary. <br />4. Please revise the proposed mining of the wildlife buffer between current Phase I and Il to leave the entirety of the <br />wetland located on the northeast end of the 200 foot wide buffer strip. <br />5. Contours of the final pit slopes on the Reclamation Plan Map are not consistent with the slope grades specified in the <br />proposed reclamation plan text. Please correct this discrepancy. <br />6. Please remove the conservation easement notation from the map legends where the easement is not shown on the <br />maps.
