RULE 2 PERMITS <br />The legal or equitable owners of record of the property to be mined or affected by surface operations and <br />facilities incidental thereto are: <br />Colowo, <br />State of Colorado, 1313 Sherman Street Room 620, Denver CO 80203, <br />Bureau of Land Management, 455 Emerson Street, Craig CO 81625, <br />The legal or equitable owner of record of the coal to be mined is the United States of America, the State <br />of Colorado and Guy and Holmes Shefstead, P.O. box 608, Craig, Colo. 81626 <br />Colowyo is the holder of Federal Coal Lease No. D-034365, "C"35874 and C-29224 and State of <br />Colorado Coal Lease 257-135. <br />The surface and mineral ownership in the permit and adjacent areas is graphically shown on the Surface <br />Ownership Map (Map 1) and the Coal Ownership Map (Map 2) and the information found in Exhibit 1, <br />Documents and Leases. <br />Colowyo is the only holder of record of any leasehold interest in the property to be mined or to be <br />affected by surface operations and facilities incidental thereto. There are no other holders of record of <br />any leasehold interests for areas located within the property boundary. <br />Colowyo is both the applicant for the permit and the operator of the mine. The resident agent of Colowyo <br />who will accept service of process, including the telephone number, is as follows: <br />CT Corporation System <br />1675 Broadway <br />Denver, Colorado 80202 <br />(303) 629-2500 <br />Colowyo Coal Company L.P. will remit all required AML fees. <br />Colowyo is a limited partnership duly authorized to do business in the State of Colorado. Effective <br />December 6, 1994, Kennecott Colorado Coal Company, a Delaware corporation, became the sole general <br />partner of Colowyo Coal Company L.P. Gracoal, Inc., a Delaware corporation and Gracoal II, Inc., a <br />Delaware corporation, are the limited partners. (Gracoal, Inc. and Gracoal 11, Inc. are identified here for <br />informational purposes only and are not "owners or controllers" of Colowyo.) <br />There is no pending purchaser of record of any surface or mineral estate under a real estate contract for <br />areas located within the permit boundary. <br />The information required under Rule 2.03.4 regarding surface coal mining permit information through <br />"ownership and control" relationship is provided in Exhibit 2 of this Permit. <br />Information regarding the internal Permit area and contiguous surface and subsurface ownership may be <br />found in Exhibit 1, Item 11. <br />Colowyo owns various interests in land contiguous to the Colowyo Permit Area.
