RULE 2 PERMITS <br />2.02 GENERAL REQUIREMENTS FOR COAL EXPLORATION <br />2.02.1 Scope <br />The scope of this section establishes requirement's for coal exploration and is intended to insure that <br />such exploration and is intended to insure that such exploration is conducted in a manner that protects <br />the environment and complies with the existing governmental regulations. These regulations include <br />filing notices of intent when 250 tons or less of coal will be removed during exploration and applying <br />for written approval when more than 250 tons of coal will be removed during exploration. <br />2.02.2 Exploration Involving Removal of 250 Tons or Less of Coal <br />Colowyo hereby gives written notice of its intent to conduct coal exploration during which less than <br />250 tons of coal will be removed. Exploration taking place inside and outside of the permit area will be <br />handled through the Notice of Intent (NOI) area will be handled through the Notice of Intent (NOI) <br />procedures. See the appropriate NOI for details for each program. <br />With the approval of Technical revision 50, all exploration holes located within the permit boundary <br />are transferred to NOI X-95-109-5 and are managed under Coal Exploration procedures. <br />Wells drilled as an integral part of water monitoring plans identified in the PAP (Permit C-81-019) and <br />water supply wells (for mining purposes) are managed under this Permit C-81-019. <br />The name, address and telephone number of the person seeking to explore is: Colowyo Coal Company <br />L.P., 5731 State Highway 13, Meeker, Colorado 81641; (970) 824-1500. <br />The name, address and telephone number of the representative who will be present at and responsible <br />for conducting the exploration activities is: Juan Garcia, Senior Mining Engineer, Colowyo Coal <br />Company, 5731 State Highway 13, Meeker, Colorado 81641; (970) 824-1500. <br />Colowyo owns all land or has right of entry for lands on which it intends to explore. <br />A description of the practices to be followed to protect the environment from possible adverse impacts as <br />a result of exploration activities is as follows: <br />Where possible, drill hole sites will be located-next to existing roads and trails. If necessary, a bulldozer <br />will be used to construct a level bench for the drill after topsoil is removed. Existing roads and trails will <br />be utilized wherever possible, and movement by equipment across undisturbed terrain will be kept to a <br />minimum. <br />Except as provided below, if existing roads or trails are disturbed by the exploration activities, they will <br />be bladed and returned to the condition equal to or better than their condition prior to commencement of <br />the exploration activities. New or additional roads will be constructed only immediately prior to drilling <br />operations. At the conclusion of the exploration activity and except as provided below, new or additional <br />roads will be bladed and reseeded. All roads will have water bars and/or culverts installed, if necessary, to <br />prevent excessive erosion. Fire protection will be maintained by keeping all trash and debris from <br />accumulating. Adequate fire extinguishers will be maintained and available at each drilling site. <br />The drilling sites, at the conclusion of the exploration activity will be cleaned of trash and debris, leveled, <br />retopsoiled, scarified and reseeded to prevent soil erosion.
