RULE 2 PERMITS <br />RULE 2 PERMITS <br />2.01 GENERAL REQUIREMENTS <br />2.01.1 Scope <br />The scope of this section establishes the minimum general requirements for permits required to continue <br />surface coal mining and reclamation operations under the Colorado regulatory framework. The objective <br />of this section is to insure that all operations make timely application for permits, and that all surface coal <br />mining and reclamation operations are conducted only under permits issued in accordance with the <br />requirements of the Colorado Surface Coal Mining Reclamation Act and regulations promulgated <br />thereunder. <br />2.01.2 General Requirements for Existing Operations <br />The information contained within this application is designed to effect compliance with the regulations of <br />the approved Colorado program. Therefore, the format of this application has been developed to follow <br />the requirements of the Colorado regulatory program. <br />As required, Colowyo filed its initial application on February 5, 1981 with the Colorado Mined Land <br />Reclamation Division to meet the regulatory requirement of not later than two months following the date <br />of approval (December 15, 1980) of the Colorado regulatory program by the United States Secretary of <br />Interior to comply with the additional applicable provisions of Rules 2 and 4. <br />2.01.3 General Requirements for Permits for All Surface Coal Mining Operations <br />Colowyo has prepared this application in compliance with the applicable requirements of Rules 2 and 4 <br />of the approved Colorado program. <br />2.01.4 Permit Requirements for New Surface Coal Mining and Reclamation Operations <br />Because the Colowyo operation is an existing mine, the requirements of this Section are not applicable to <br />Colowyo. <br />2.01.5 Permit Term <br />Colowyo originally submitted the initial permit application with a request for life-of-mine approval <br />because Colowyo has three long-term contracts with major electric generating facilities, because of the <br />nature of these contracts, and the extensive capital expense commitment made by Colowyo. The <br />Division determined that a variance of the standard five-year permit term could not be granted since the <br />specific financial justifications could not be provided. However, it was determined by the Division that <br />the initial application was complete for the life-of-mine. Subsequently, the Division made findings and <br />on November 11, 1982 approved the entire permit area, which also represented the initial life-of-mine <br />area. The initial permit area had the right of successive renewal for successive five-year permit terms. <br />Colowyo is hereby submitting the complete information necessary for the Division to make a finding that <br />the permit revision incorporating Federal Lease C-29224 and State Coal Lease 257/13S is complete for <br />the life-of-mine. With approval of this application, we are requesting approval of the entire permit area <br />which also represents the life-of-mine area.
