Therefore, the Division approved those activities (4.04(6)). A list of approved facilities <br />may be found in Section 2.05.3(3) of the permit. <br />III. Hydrologic Balance - Rule 4.05 <br />A. Water Quality Standards and Effluent Limitations <br />The Division granted approval for small area exemptions from the use of <br />sediment ponds, due to the limited size of the areas and due to the fact that ponds <br />and treatment facilities are not necessary for the drainage to meet the effluent <br />limitations of Rule 4.05.2 and applicable State and Federal water quality <br />standards for receiving streams, and also due to the fact that no mixing of surface <br />drainage with a discharge form underground workings will occur. The locations <br />of the small areas to be exempted are discussed on Page 2.05-32 of the permit <br />application and are shown on permit document Map 21-1 and Map 95266-02 <br />(4.05.2(3)(b)(i)). <br />Storm runoff from seventeen small areas at the mine site are subjected to <br />alternate treatment prior to leaving the permit area. The sixteen areas are 1.) the <br />"material storage area below Pond C, 2.) the pump station, 3.) the topsoil <br />stockpile near the Gob pile, 4.) the coverfill stockpile and coverfill topsoil <br />stockpile near the Gob pile, 5.) the area around the mine engineer's building, 6.) <br />the Freeman Gulch vent fan site, 7) the area underneath the conveyor, between <br />old State Highway 133 and the Fire mountain Canal, 8) nine small areas along <br />the train loadout railroad track outslopes and 9) the Hubbard creek vent shaft pad. <br />In addition, alternate sediment control measures are employed at several methane <br />de-gas drill pads. <br />2. The Division granted an exemption from the use of sediment ponds for drainage <br />from underground mine workings as long as no mixing with surface drainage will <br />occur and as long as ponds and treatment facilities are not necessary for the <br />drainage to meet effluent limitations of Rule 4.05.2 and applicable State and <br />Federal water quality standards for receiving streams (4.05.2(3)(b)(ii)). <br />B. Diversions and Conveyance of Overland Flow <br />The Division does not propose to approve a permanent diversion (4.05.3(2)). <br />2. The Division approved construction of a diversion on an existing landslide <br />(4.05.3(4)). <br />C. Stream Channel Diversions <br />The Division does not propose to approve the diversion of an ephemeral stream <br />draining at least one (1) square mile, an intermittent or a perennial stream <br />(4.05.4(1) and (4)). <br />2. Channel lining structures, retention basins, and artificial channel roughness <br />structures are proposed for use to control erosion. These means were approved <br />by the Division, since they are necessary to control erosion, they are stable and <br />will require infrequent maintenance (4.05.4(2)(a)). <br />27
