Dear Mr. Musick: I am responding to your letter dated November 6, 2008. You had determined the Western Fuels application complete. However, the acceptance of the NOI was subject to receiving the reclamation bond and proof of right of entry. Please note the following: Western Fuels disagrees with the bond amount of $43,733 computed by DRMS. I understand George O'Hara of our office is discussing this issue with you. Please send us a revised bond amount based upon the outcome of the discussion with Mr. O'Hara. Additionally, the NOI discussed drilling 52 drill holes. Now we have revised the number to 45 drill holes. Of these we have received land owner permission for 26 holes. We are still waiting for permission for the remaining 19 holes. I have attached a map to show these holes separately. Table 1 attached with the letter gives information on the holes with access granted. A subsequent table gives information on holes with access not yet granted. We request that DRMS re- compute the bond amount for all 45 holes but accept the NOI and issue the permit at this time for the following 26 holes with right of entry.
