operator. <br />Submittal of Bond Release Application and Completeness Determination by the <br />Division <br />The Division received TMI's bond release application SL-09 on October 3, 2008. The <br />application was found complete on October 6, 2008, after the Division received proof of <br />publication of the applicant's public notice. The completeness determination was made in <br />accordance with Section 3.03.2(1)(d). <br />TMI submitted the bond release application following the procedures described in the Act <br />and Regulations. The application also utilized the Division's Guideline Regarding Selected <br />Coal Mine Bond Release Issues, dated April 18, 1995. <br />Public Notice <br />TMI published notice of the bond release application in the Craig Daily Press once weekly <br />for four consecutive weeks, beginning on August 22, 2008. TMI also notified landowners <br />within and adjacent to the mine permit area, and other interested parties of the application for <br />bond release, as required by section 3.03.2(1). The Division received no written comments, <br />objections, or requests for an informal conference regarding the bond release application. <br />Bond Release Inspection <br />The Division scheduled and conducted a bond release inspection on October 13, 2008 <br />through October 16, 2008. The site inspection was conducted in accordance with Section <br />3.03.2(2). Jason Musick and Daniel Hernandez represented the Colorado Division of <br />Reclamation, Mining, and Safety. The operator was represented by Graham Roberts and <br />Forrest Luke of Trapper Mining, Inc. Christine Belka and Jennifer Maiolo represented the <br />US Office of Surface Mining and the US Bureau of Land Management respectively. It was <br />determined during this initial inspection that some gully and drainage maintenance was <br />needed. <br />The Division conducted a second inspection on November 12, 2008 to ensure maintenance <br />items noted during the October 13?h inspection had been adequately addressed. Jason Musick <br />represented the Division, Christine Belka represented the Office of Surface Mining and <br />Graham Roberts represented the operator during the inspection. <br />III.
