As usual, Oxbow will salvage as much topsoil material as possible, but the 1,000 <br />cubic yards seemed to be a reasonable estimate. <br />Comment 2. Closure plan. We anticipate closing the shaft with backfill the entire depth of the <br />shaft and capping with a concrete cap. We have included herein for inclusion into EXHIBIT 2.05 - E5 <br />RECLAMATION DETAILS a drawing titled "Typical Shaft Closure Plan - 11/21/2008 - Concrete Cap <br />Design" showing the details of a typical shaft closure. <br />Comment 3. The revised Drawing 2.05-El-BCA2 shows in detail the relationship between the <br />existing Bear Creek Ranch Road, the fansite facility, and proposed light use road around the perimeter of <br />the site. The Drawing 2.05-M6 provides the information regarding the site after reclamation, and how the <br />pre-existing Bear Creek Ranch road will remain as a permanent feature after reclamation. Much of the <br />fansite facility will be accessible at grade from the ranch road. We anticipate that the Bear Creek Ranch <br />Road will require some improvement and maintenance by the addition of road gravel, minor grade <br />improvement and cleaning of ditches, etc. We anticipate that none of these minor maintenance <br />improvements will require future reclamation work or would be included in a cost estimate. <br />Oxbow has reviewed the proposed TR-60 cost estimate and find it typically overly conservative, but <br />acceptable. <br />Please contact me at 970-929-5806 if I can provide any additional information or if you have any <br />questions. <br />Sincerely, <br />Q?yrr? <br />ames A.
