M. COMMENTS-COMPLIANCE <br /> Below are comments on the inspection. The comments include discussion of observations made during the <br /> inspection. Comments also describe any enforcement actions taken during the inspection and the facts or <br /> evidence supporting the enforcement action. <br /> This was a complete inspection conducted by Joe Dudash of the Colorado DBMS.Jim Kiger represented the <br /> operator during the inspection and records check. The weather was warm and no snow was in the general area. <br /> Roads <br /> The paved main entrance haul road was in good condition.The guard rail was in place.No coal fines were on <br /> the road or on the main highway at the entrance.The east side graveled road was also in good condition.The <br /> east gate was open.The light use road along the railroad tracks was dry and passable. <br /> Sims and Markers <br /> The mine id signs contained the required information.The signs were located at the main entrance,the east <br /> entrance and along the road near the railroad tracks. Permit boundary markers were also up. <br /> Facilities <br /> There were no issues with the coal haul truck unloading facilities,the crusher/screener facilities and the coal <br /> train loading facilities.Trucks were unloading coal but no coal rail cars were being loaded during the inspection, <br /> although several filled rail cars were on site.No fugitive dust was observed going offsite. <br /> There were no leaks at the fuel facility.No problems were observed at the loadout office,material storage area <br /> and the substation.There was only a small volume of coal stockpiled on the facilities bench. <br /> Hvdrolou <br /> There was only a very small pool of water in the east side sediment pond.The pond's spillways were functional. <br /> The gated valve on the east side pond was closed.The embankment was well vegetated and the emergency <br /> spillway was clear of debris. The west side sediment pond was dry.The open channel spillway was functional. <br /> The straw bales and silt fence were in position along the railroad track small area exemption.The culverts at the <br /> loadout were clear and the ditches had sufficient capacity. <br /> Topsoil <br /> The west side topsoil stockpile had a good vegetative cover.There were no signs of erosional problems.The <br /> berm and ditch were in place to protect the stockpile.The topsoil sign was up.The vegetative cover on the east <br /> topsoil stockpile was moderate.The collection and diversion ditches were in place and the topsoil sign was up. <br /> Records <br /> The required records were located in the loadout office,as documented on the attached records checklist. <br /> c:/word/terror/insp 1108 <br />
