III. COMMENTS-COMPLIANCE <br /> Below are comments on the inspection. The comments include discussion of observations made during the <br /> inspection. Comments also describe any enforcement actions taken during the inspection and the facts or <br /> evidence supporting the enforcement action. <br /> This was a partial inspection conducted by Joe Dudash of the Colorado DRMS.No one represented the <br /> operator,Bear Coal Company,during the field inspection. <br /> Roads <br /> The paved mine road leading down to the reclaimed mine site was clear of debris.The bridge also was passable. <br /> Sims and Markers <br /> The mine ID sign and post were on the ground at the top of the hill and need to be put back up. Surface <br /> disturbance markers were up around the site. <br /> Facilities <br /> The debris from the demolished mine office has been transported offsite,except for several tires.The mine <br /> office foundation concrete has been broken up into sections.The concrete pad is still in place. <br /> Hydrology <br /> There was a small volume of standing water in the sediment pond.The sediment pond's primary discharge valve <br /> was in the closed position.The hillside spring water treatment pond was discharging at a rate of about 10 to 15 <br /> gallons per minute.The discharge was the usual orange color,which has been determined to be in compliance. <br /> The temperature of the hillside spring water was measured at a point that was about 6 feet below the origin on <br /> the hillside.The temperature was 101 degrees Fahrenheit. <br /> The collection ditch that leads into the sediment pond had sufficient capacity and was well vegetated.The river <br /> protection berm had sufficient height to protect the flat facilities area from the river when it is at flood stage. <br /> The well caps were on both alluvial wells. <br /> Noxious Weeds <br /> The operator has cut down tamarisk plants that were growing along the fence at the mine gate and also cut down <br /> some of the tamarisk plants at the location of the hillside spring.More tamarisk plants need to be cut down and <br /> treated at the hillside spring area and at the hillside spring water treatment pond. <br /> c:/word/bear3/insp 1108 <br />
