On behalf of Bowie Resources, LLC, "BRL", following are its responses to the <br />DRMS' comments and concerns. <br />DRMS - The Division will conduct an Applicant Violator System (AVS) computer check of <br />the Bowie No. 2 Mine permit during this adequacy review period. The Division will <br />conduct similar AVS checks at the time of the Division's proposed decision and at <br />issuance time for PR- 11. The Division will inform BRL of the results. <br />BRL - No response required. <br />2. DRMS - As had been acknowledged in the BRL PR-11 cover letter and as had been <br />requested in the attached Colorado Historical Society (CHS) comment letter dated <br />February 20, 2008, please provide a cultural resource survey for the federal lease <br />modification area. The Division will forward a copy to the CHS for their review. <br />BRL - A cultural resource survey for the federal lease modification area is enclosed. <br />3. DRMS - The issues of ground water points of compliance under Rule 4.05.13(1) and <br />down gradient ground water baseline monitoring under Rule 2.04.7(1) will be dealt with in <br />PR-10. However, the plan that is approved in PR-10 will need to be applicable to the <br />mine plan proposed in PR-11 as well. <br />BRL - BRL believes the PR-10 approval of ground water points of compliance and down <br />gradient ground water monitoring wells are applicable to PR-11. This is demonstrated by <br />reviewing the enclosed Maps 10, 11 and 11-1 amended with the PR-11 permit boundary. <br />4. DRMS - Rule 2.04.7(3) requires alternate water supply information if contamination, <br />diminution or interruption of a surface water source may result from the effects of mining. <br />This issue will be dealt with in PRA 0.
