concerned that the commitment for the 2008-2012 time frame will be not <br />achieved. In summary, the Division is concerned that Colowyo is not <br />achieving the backfilling and grading commitments in the West Pit and is not <br />demonstrating contemporaneous reclamation. <br />In order to complete the committed spoil grading and to demonstrate <br />compliance with the Rules regarding contemporaneous reclamation, the <br />Division is requesting that Colowyo submit a detailed plan that will <br />accomplish the regrading of the approximately 430 acres in the West Pit. <br />The regrading in the West Pit, including the removal of Hink's Peak, will <br />need to be completed no later than 31 December 2009. Please submit the <br />revised plan in the form of a Technical Revision and submit it to the <br />Division no later than 23 January 2009. <br />10. In 2007 Colowyo regraded 0 acres in the East Pit. Map 29 - Regrading Plan, <br />shows Colowyo committed to have 250 additional acres regraded in the East <br />Pit. This area has the topic of discussion following the issuance of Notice of <br />Violation CV-2008-004 and the resulting assessment conference. Colowyo <br />will submit a new regrading plan for the East Pit. Colowyo has committed to <br />submitting a "short term" plan, for the area surrounding the Prospect Ditch <br />and the sumping of water into the East Pit, by 24 December 2008. Colowyo <br />has also committed to submitting a "long term" plan for the remaining East Pit <br />no later than 31 March 2009.
