2.05.3 <br />During 2007 a shaft construction site was constructed in the Hubbard <br />Creek drainage along the Hubbard Creek road. The Hubbard Creek shaft <br />pad was strewn with large sandstone boulders. These boulders were <br />mechanically broken into X24" minus rocks. Some of the rocks were used <br />on site to stabilize cut and fill slopes. Some were taken to a temporary <br />rock storage area near Freeman Gulch. Minor revision number 83 <br />allowed the remaining rocks, approximately 3,000 cubic yards, to be <br />hauled to the Bowie No. 1 .East Mine reclamation project. Approximately <br />160 cubic yards of rock were initially hauled to the Bowie No. 1 Mine. An <br />additional 1,140 cubic yards of rock and dirt were hauled to the Bowie No. <br />Mine during March and April 2008. <br />The Town of Paonia expressed an interest in the rock to backfill its <br />sewage lagoons. Therefore, the Operator redirected approximately 1,700 <br />cubic yards of the rock to the Town's sewage lagoons. The Operator and <br />the Town intend on leaving the rock permanently at the sewage lagoons. <br />Tab 14 of Volume IIIA has',a copy of the letter from the Town of Paonia to <br />the Operator dated December 4, 2007 in which the Town agreed to <br />• accept the donated rock. <br />USDA-FS invoices for the 'rock placed at the Bowie No. 1 mine and the <br />Paonia sewage lagoons and a copy of the check demonstrating payment <br />are located in Volume III, Tab 14. <br />The shaft site encompasses approximately 1.6 acres. Permanently <br />exporting 3,000 cubic yards from this site would lower the final contours of <br />the site approximately 1.2 feet which is considered insignificant. <br />The geochemical analysis of the sandstone presented in Volume III, Tab <br />6 demonstrate that the sandstone is non-toxic and non acid forming. <br />The Operator will export additional material from the shaft site beginning <br />in April 2008. Approximately 3,000 cubic yards will temporarily be placed <br />in the Bowie No. 1 Mine highway stockpile area.
