Cattany <br /> Division Director <br />Re: Carbon Junction Mine (Permit C-92-080) Natural Resource Trustee <br />Bond Release Application SL-4 <br />Dear Mr. Savage: <br />In accordance with Rule 3.03.2(2), we are conducting a review of the above-referenced <br />application. As part of the review, we are evaluating compliance with Rule 3.02.3(2)(c). This <br />Rule requires the permittee to demonstrate that development of the post-mining land use has <br />substantially commenced and is likely to be achieved. <br />As the permittee has previously demonstrated, the bond release area is comprised of individual <br />tax parcels and a map of those parcels is recorded in the office of the La Plata County Clerk and <br />Recorder. Please submit any additional information regarding on-the-ground activities or county <br />approvals that would indicate residential development has substantially commenced and is likely <br />to be achieved. <br />We have asked La Plata County what further approvals will be needed before residential <br />development work can occur at the Carbon Junction site (see attached copy of letter of <br />November 25, 2008). <br />Sincerely, <br /> <br />Tom Kaldenbach <br />cc: Daniel I.
