STIPULATION NO. 19 <br />DOCUMENTATION OF OFFICE OF STATE ENGINEER APPROVAL OF <br />PONDS 010, 013, AND 014 AS PERMANENT IMPOUNDMENTS, ALONG <br />WITH DOCUMENTATION THAT ANY NECESSARY WATER RIGHTS <br />HAVE BEEN OBTAINED FOR THE IMPOUNDMENTS, WILL BE PROVIDED <br />TO THE DIVISION PRIOR TO FINAL BOND RELEASE APPLICATION FOR <br />THE IMPOUNDMENTS. <br />23. The Division requested documentation that proper notification to the Office of State Engineer <br />had been made for Yoast Stockpond ST-1, and such documentation was provided, in the form <br />of a completed State Engineer livestock tank reporting form, that was submitted to the <br />Steamboat Springs Office Office of the Division of Water Resources, Office of State Engineer. <br />The form was submitted as in insertion page for Attachment 20-1, Appendix 20-1.2 of the PAP. <br />Item Resolved. <br />26. In Item 26, the Division had noted the fact that necessary landowner requests (from YVEA and <br />PSCO) for retention of the power line extending from the Rockcastle Road up through the <br />permit area to the substation had not yet been provided, and further advised that "the pending <br />SL-2 phase 1 bond release application will need to be amended to exclude the YVEA power <br />line from the area requested for release". <br />SCC indicated their preference would be for the Division to address the deficiency in the <br />context of the pending bond release application. We will agree to address the issue in the bond <br />release review. If the necessary documentation is not provided, the power line corridor and <br />substation area will be excluded from the Phase '1 release approval area, in the Division's <br />proposed decision on the bond release application. Item Resolved. <br />28. The Division had noted that the pending phase 1 bond release for areas within the YPM-8 <br />watershed, between the southern end of Road LU3A and the northern end of Road LU3B was <br />complicated by the fact that operational roads were still in place, but the roads have not been <br />approved as permanent and thus are not depicted on the postmining topography map. The <br />operator responded by noting that the actual road corridors were specifically excluded from the <br />pending bond release request, which is the case. The Division will agree to evaluate these <br />concerns during the bond release review, and assess whether exclusion of the narrow road <br />corridors is sufficient, or whether a larger area in the vicinity of the existing roads may need to <br />be excluded from the bond release approval area.
