Cattany <br />Division Director <br />Natural Resource Trustee <br />The Division has reviewed Seneca Coal Company's (SCC's) responses to our adequacy review for TR- <br />37 for the Yoast Mine (response to Items 20, 23, 26, and 28 of the 10/6/08 review letter). <br />Although not all of the remaining items were addressed in the way that we requested, we have <br />determined that the response is adequate to allow for us to issue a proposed decision to approve the <br />application, with one stipulation. Please see the enclosed item specific evaluation, along with wording <br />of the proposed stipulation.
