While reviewing the <br /> file, I noted that you had requested a letter outlining any other permitting <br /> requirements which might be required by the Department. This letter is <br /> intended to provide that information. <br /> Specifically, the concern was raised that the tailing deposition area might be <br /> subject to the Certificate of Designation requirement of the State's solid <br /> waste regulations. In general, a Certificate of Designation is required for <br /> the processing, treatment, or final disposal of solid waste. There is, <br /> however, an exemption provided which is applicable to the tailing <br /> stabilization program. Section 1.4.4 of the Colorado Regulations Pertaining <br /> to Solid Waste Disposal Sites and Facilities exempts "Those sites where sludge <br /> is used beneficially as a fertilizer, soil conditioner, fuel or livestock <br /> feed, provided the sludge is certified to have met the requirements of the <br /> department and the Department of Agriculture." The Notice of Authorization <br /> issued to Summit County provides the necessary certification, allowing <br /> implementation of the exemption provision (Department of Agriculture <br /> regulations address only sludge which is marketed as a fertilizer) . <br /> Because section 1.4.4 allows only the final disposal of sludge to be exempt, <br /> the Department has required designation of sludge processing or treatment <br /> facilities, such as composting operations, when they are not located at a <br /> wastewater treatment plant (and therefore regulated through the State's site <br /> approval and discharge permit programs) . There will be no processing or <br /> treatment of the sludge which takes place at the tailing area, only final <br /> disposal. Therefore, no Certificate of Designation will be required. <br />
