9/30/2008 <br />aFCEIVE® <br />Colorado Division of Reclamation, Mining, and Safety ?IOV 2 I NOB <br />1313 Sherman Street, Rm 215 <br />and Sat* n, <br />Denver, CO 80203 <br />To whom it may concern; <br />This letter to serve as a withdrawal of Terror Ditch and Reservoir's <br />opposition to PRs 10& 11. We have just reached an agreement for mitigation <br />with Bowie Resources LLC. <br />This agreement is a compilation of crop insurance (for yield losses), bonds <br />(for cash penalties) and a minimal amount of water that has the advantage of <br />being available late in season (as some of our commercial crops can use a <br />good watering after harvest). <br />Even with this in mind TDRC looks to its government agencies to insure a <br />preventable catastrophe (dam failure) does not needlessly occur.
