ERC reviewed the Study Area and <br />determined that no wetlands/waters are present within the Study Area. <br />ERC identified and delineated two wetlands located immediately adjacent to the Study Area. <br />Neither Wetland A nor Wetland B is located within the Study Area. Although neither wetland is <br />located within the Study Area, both Wetland A and Wetland B are subject to jurisdiction under <br />the Clean Water Act due to their direct surface connection to the Arkansas River. The placement <br />of fill material or any general land disturbance within the mapped Waters of the US/Jurisdictional <br />wetland will require prior authorization from the USACE. The attached Wetland Delineation Map <br />dated August 31, 2007, represents the delineated wetlands and waters adjacent to the Study Area. <br />The USACE has final authority over validation of exact jurisdictional wetland boundary location <br />established by consultants. Therefore ERC recommends that this report be submitted to the <br />USACE Southern Colorado Regulatory Office (200 South Santa Fe Avenue, Suite 301, Pueblo, <br />CO 81003) for written verification and jurisdictional determination prior to construction. <br />This report has been prepared by: <br />Ecological Resource Consultants, Inc. <br />Kristin A.
