Cattany <br />Division Director <br />Natural Resource Trustee <br />Re: NCCI Pit #1, Permit No. M-2001-107, Amendment Approval, Revision No. AM-1 <br />Dear Mr. Zadel: <br />On December 24, 2007 the Division of Reclamation, Mining and Safety (Division) approved the Amendment application <br />submitted to the Division on August 27, 2007, addressing the following: <br />Acreage Increase of 72.86 acres. <br />The terms of the Amendment No. 1 approved by the Division are hereby incorporated into Permit No. M-2001-107. All <br />other conditions and requirements of Permit No. M-2001-107 remain in full force and effect. <br />The total financial warranty amount of $1,338,509.00 proposed by the Operator, for the existing permit plus the <br />expansion proposed under Amendment AM-l, has been determined by the Division to be adequate. The phased bonding <br />approach proposed by the Operator is also approved by the Division. The amount of financial warranty currently held by <br />the Division for this permit is $767,983.00. The total amount of bond that must be held by the Division upon initiation of <br />the first phase of the expansion will be $947,991.00, which is an increase of $180,008.00 over the amount currently held. <br />Therefore, in accordance with Rule 4.1(2), the operator must submit additional bond in the amount of $180,008.00 within <br />365 days of the date of approval of the amendment (December 24, 2007) , or upon initiation of mining in the expanded <br />area, whichever occurs first.
