However, we recognize that there is a possibility that Conejos County Land Use, within their authority
of approving a special use permit, may issue differing requirements or constraints upon your future
operation, which might negate or conflict with some of the details of your approved plans under the
DRMS permit. I understand through recent discussion with the county that you are currently seeking
approval of a special use permit, a decision for which could be made by the commissioners next
month. Therefore, in order that you may avoid possibly having to apply for a revision to your 112c
permit (costing an additional $216 fee) at this time we will postpone the DRMS decision date, and
await the outcome of that county process. We urge you to continue to pursue the county special use
permit, and inform me of their decision and any special conditions that may affect your DRMS permit.
For now, since I do not know what, if any, conditions may be imposed, I will begin estimating the
bond amount that will be required upon our approval of your 112c permit conversion. If you know
what type of bond you want to post for the permit, you may request the appropriate forms from me (in
the Durango field office) or from Elizabeth Taliaferro at our Denver office (see letterhead above).
I look forward to the successful resolutions of the two separate, ongoing permit processes. If you have
questions, I may be reached at the Division's Durango field office: 701 Camino del Rio, Room 315,
Durango, CO 81301; telephone 970-247-5193. Please note our new room number, above.
Sincerely,
0? X44
Bob Oswald
Environmental Protection Specialist
Cc: Linda L.
