Cattany <br />Division Director <br />Natural Resource Trustee <br />Dear Party and/or Interested Person: <br />On January 8, 2008, the Division received a request from Battle Mountain Resources, Inc. (Battle <br />Mountain) to withdraw AM-02. Therefore, the application for AM-02 has been withdrawn and the review <br />process for AM-02 has been terminated. <br />Battle Mountain has submitted a new amendment application, AM-03, for the San Luis Project. <br />According to the application for AM-03, Battle Mountain proposes to add 977 acres to the permit area <br />and to transfer ground water from the West Pit to the adjacent ranch for use as irrigation supply water. <br />As of January 4, 2008, the review process and associated comment period for AM-03 has commenced. <br />Please note that comments previously filed in conjunction with AM-02 will not be considered filed <br />in regard to AM-03 If you wish to comment on AM-03 you must timely file new comments. <br />Pursuant to Rule 1.7.1 of the Mineral Rules and Regulations of the Colorado Mined Land Reclamation <br />Board for Hard Rock, Metal and Designated Mining Operations, any person has the right to submit <br />written statements supporting or objecting to AM-03. Written comments, protests and/or petitions for a <br />hearing must contain the name, mailing address and telephone number of the interested parties. In <br />order to be considered timely, such comments, protests, and petitions must be submitted not more than <br />20 days following the fourth publication of the public notice, to be published once a week for four <br />consecutive weeks in a newspaper of general circulation in the locality of the proposed operation. If you <br />are interested in commenting on AM-03, you should check your local newspapers for the above <br />described notice.
