TR-37, PAP Update and
Permanent Facilities Request
Page 3
Phase I Bond Release application for the reclaimed area corridor extending from LU-3A and LU-
3B, including the entire YPM-8 watershed.
Note that the above request mill necessitate a modification of the pending SL-2, Phase I bond release application to remove
the subject corridor fmm the area requested for release.
Response: As SCC has indicated previously, we have no indication of what the BLM's final internal decision
will be; therefore we have left the road corridor off of Exhibit 20-2. However, no matter the final BLM
decision, the drainage channel is currently functioning and is proposed to be left as constructed. It doesn't
appear that a narrative commitment within the permit application is appropriate for this one situation since a
narrative commitment has not been required for all the other similar situations. Just because a narrative
commitment is not provided, it doesn't mean that appropriate documentation will not be provided if and
when it is received as required by the Rules and Regulations.
With regard to modifying SL-2, Phase I Bond Release, if the Division reviews Exhibit A, Phase I Bond
Release (Part 2) it will be evident that this subject corridor has been left out of the bond release request.
Attached are revised/updated material and insertion instructions. Two copies of this response have been sent
to you at the Grand junction office and a third copy, also addressed to you, has been sent to the Division's
Denver office. Should you or any other member of the Division have questions regarding the information,
please contact me at (970) 276-5227 or (970) 846-3648.
Sincerely,
Roy A.
