The revised text forAppendix 13-9, states that water sampling during the bond release period will be used to confirm the <br />assumption that there are antidpated problems with regard to water quality at all of the stock ponds Since SCC is well into <br />the bond release period this would be an appropriate time to confirm water quality at all of the stock ponds that are to be <br />retained as permanent. Please provide the DRMS with a specific commitment to conduct water sampling and analysis to <br />demonstrate compliance with 4.05.9(13)(a). <br />Response: SCC will provide water quality documentation per the commitment stated in Appendix 13-9. <br />The sampling is anticipated to be conducted in the 2°`' quarter of 2009 as soon as weather conditions permit. <br />The analyses documentation will be submitted after it is received from the laboratory and verified. <br />4. The table listing on page 1 of the amended Appendix 13-9 text, which lists `Stock Ponds to be Retained as Permanent <br />Structures" appears to have a couple errors. The listing erroneously includes Stock Pond T-9(not listed elsewhere in text, <br />tables, and maps), and does not list Stock Pond T-8 and T-16 (which are listed in the various other text sections, tables and <br />maps). Please correct the table and provide a revised page 1 ofAppendix 13-9. <br />Response: SCC has revised page 1. <br />Attached are the required application form, public notice, insertion instructions, and the revised/updated <br />material. Enclosed are two (2) copies of an application for a technical revision to the Seneca II Mine Permit <br />(C-80-0005). A third copy has been sent to the Division's Denver Office also addressed to you.
