Bagley <br />Copies of the deeds and legal rights to enter are included in Exhibit's N and 0 of <br />the attached Colorado Division of Reclamation, Mining and Safety (DRMS) <br />application. <br />• A noise report is not included, but will be provided if deemed necessary by the <br />Weld County Planning Department. Activity on the site will continue in the <br />historic manner and has shown to be compatible with adjacent land uses. <br />• Soils information is included as Exhibit I of the DRMS application. <br />• A list of the names, addresses and the corresponding parcel identification <br />numbers assigned by the Weld County Assessors Office for surrounding property <br />owners is attached. The list complies with the thirty-day requirement. <br />• A list of the names and addresses of mineral owners and lessees of minerals on <br />or under the parcel of land being considered in the amendment is attached. We <br />will get an updated report, once staff has reviewed our complete submittal and <br />set a date for the public hearing. <br />• A complete copy of the application to amend the existing DRMS 112 Permit is <br />enclosed for review. The DRMS application is also under review at the State. <br />We will keep you informed of our progress. <br />• We are continuing to work with the mineral rights owners and lessees regarding <br />shared use of the surface on the site. Aggregate Industries has existing <br />agreements with Ed Orr and Noble Energy for portions of the property. Copies <br />of the existing agreements and relevant correspondence are attached. <br />• Several field drains and irrigation pipeline traverse the portion of the site <br />included in the amended area. AI is meeting with the effected ditch companies <br />and landowners to determine the best options for continued operation of the <br />ditches and diversions of the existing field drains. Existing and relocated <br />pipelines are shown on the existing conditions map and mining plan. <br />• Other information determined necessary by the Board of County Commissioners <br />or the Department of Planning Services will be provided upon request. <br />E010
