16) No corrections, clarifications, or confirmations made, as none were requested by DRMS. <br />17) Additional letters have been sent out to the remaining parties as described by Rule 3.03.2(1), <br />copies of which have been added to Appendix A. <br />18) The areas stated within the bond release report are correct: 241.5 acres of Irrigated Pasture <br />and 62 acres of Dryland Pasture. The discrepancy is due to BIO-Logic's areas being approximate <br />areas based on loosely drawn lines. A memo from BIO-Logic explaining this has been added to <br />Appendxi B. For the purposes of bond release, the areas contained within the report should be <br />used. <br />Road acreages are present in the Requested Phase 2 New Horizon #2 Mine Areas table. <br />19) Phase 2 release criteria is covered in the attached replacement text, along with details of the <br />requested release areas' meeting of this criteria. <br />20) All of the areas shown on Maps R-1 and R-2 are covered by the Phase 1 and Phase 2 bond <br />release request, respectively. No Phase 3 bond release is requested of any area. <br />21)The added section on Phase 2 release criteria addresses this concern. <br />22) This area has been removed from the delineated Phase 2 Area 8 bond release area. Map R-2 <br />has been updated to reflect this correction. <br />23) It has been confirmed with Western Fuels that the contours present on the map are correct for <br />the reclaimed roads. <br />24) Appendix D has been renamed in the replacement text. <br />In addition to the individual items listed above, the maps and text have been updated to reflect <br />more accurate acreages for the bond release. A replacement Map R-2 and replacement text is <br />attached to this letter.
