Box 1364 43 CFR 3602 - Mineral Materials <br />Clifton, CO 81520 Sales <br />EXPIRATION OF CONTRACT ? - = <br />BREACH OF CONTRACT <br />Dear Mr. Daugherty; <br />On October 24th, 2003, the Bureau of Land Management (BLM) issued a contract (BLM case # <br />65720) to you for the sale of 500 tons of decorative rock at the site known as Cedar Point. The <br />term of the contract was for five years and expired on October 24th, 2008. <br />Per the terms of the contract, you have sixty days from the date of October 24, 2008, to remove <br />your equipment, improvements, and other personal property. You are liable for the total <br />purchase price, even if the quantity of materials you ultimately extract is less than the total value <br />of the contract (Contract for the Sale of Mineral Materials, section 2). You may not conduct any <br />additional extraction activities other than to remove any stockpiled material, up to the total value <br />for which you have paid. Within thirty days of receiving this letter, you must send a written <br />description of how you propose to remove your personal property and reclaim the site. <br />A review of the case file shows that the total value of the material that you contracted to buy was <br />$7500. Per the terms of the contract, you were expected to pay this amount in five installments <br />of $1500 each. Our records show that you made two payments of $1500 (first and last) in 2003. <br />You followed up with payments of $1500 each, in 2004 and 2006, for a total of four installments. <br />Your actions have resulted in a breach of the terms of the contract. You owe a total of $1500 for <br />this contract. In order to remedy this breach of the contract, you must pay the BLM $1500 <br />within 30 days of receiving this letter. <br />
