• However, both AM-002 and AM-003 caused changes in the affected land boundaries within the <br /> Climax property. AM-003 inadvertently set the affected land boundary along the east-southeast <br /> side of the Mayflower tailings impoundment without consideration of the borrow area, thereby <br /> causing 7.75 acres of the borrow area to be left outside the present affected land boundary. Map <br /> 2 and Figure 1 show the extent and location of this parcel. <br /> 3.2 Storke Complex Return Water Pipeline System -Affected Land Exchange <br /> Map 3 and Figure 2 show the location of the 2.0 acres proposed for addition to the affected land <br /> area for realignment of the return water pipeline from the No. 5 shaft. Of this acreage, 1.5 acres <br /> will accommodate the main pipeline and 0.5 acres will encompass the surge line corridor. <br /> The acreage proposed for addition to the affected lands consists of two slivers of land that once <br /> were part of the affected area but were deleted in AM-002 and not added back in AM-003. This <br /> area is located just below the mill and just above Highway 91 on the south side of Fremont Pass. <br /> The acreage is sandwiched between areas of active mine-related activity and consists of late <br /> growth spruce-fir and shrubs. Both slivers have been disturbed to varying degrees by past <br /> mining activity. Pictures 3 shows this area. <br /> • 3.3 Lands Proposed for Affected Land Exchange-Deletion from Affected Lands <br /> As stated previously, Climax owns an extensive block of land around the mine and mill facilities. <br /> Approximately 1200 acres of lands undisturbed by Climax within the presently permitted <br /> affected land area are available from which to select lands for exchange. Under the provisions of <br /> the DMG exchange of affected lands policy as found in Appendix B, Climax is proposing to <br /> delete a block of 9.95 acres of undisturbed lands from the existing permitted affected land area <br /> for the Climax mine. This deletion is in exchange for adding the 7.75 acres of the Mayflower <br /> borrow site and the 2.0 acres for the Storke water return pipeline realignment into the permitted <br /> affected land area approved under AM-003. This exchange effectively deletes 0.2 acres from the <br /> total permitted affected lands at Climax. <br /> The acreage proposed for deletion from the affected lands is located north of No. 3 dam and just <br /> north of the Pond Shop as shown on Map 2 and in Figure 3. The parcel is a block of open <br /> spruce-fir(Picture 4)that has been undisturbed since the late 1800s. This parcel has been in and <br /> out of the affected land area at Climax. It was last added back into the affected land area in AM- <br /> 003. The parcel has remained undisturbed and meets the DMG exchange policy criterion for an <br /> exchange parcel. <br /> • Based upon the DMG policy protocol, the following conditions exist: <br /> 6 <br />
