Long <br />FROM: Bruce Humphries Division Director <br />RE: Additions and deletions of acreage where no disturbance has occurred - Revision to <br />the policy adopted May 31, 1996 - REVISION TO THE 9/18/98 MEMO <br />This Policy may be applied where an operator wants to add new acreage by deleting undisturbed acreage <br />from either the permitted area or affected area. This policy is applicable to any permit that may be amended. <br />Procedure: <br />The following conditions must exist: <br />• ? The area to be deleted from the permitted area or affected area must not have been <br />disturbed by the existing mining operation or any previous operator where a succession <br />of operators has occurred. The area to be added must not have been disturbed by the <br />operator. <br />? The existing reclamation plan, post mining land use, and financial warranty amount are <br />appropriate and adequate for the area to be added. <br />? If an exchange were to occur, the total new acreage must not exceed the amount deleted <br />or released. <br />The following process shall be followed: <br />? The operator shall submit a standard request for a reclamation liability release. The <br />release of the area to be deleted from the current permit or affected area needs to occur <br />prior to amendment approval. <br />? The operator shall submit a completed amendment application form. The form must <br />include all applicable exhibits. It is the responsibility of the EPS assigned the case to <br />ensure at all appropriate exhibits are part of the application prior to the Division's <br />approval or recommendation for approval. The normal amendment application fee <br />will not initially be required. However, the operator must submit the standard fee <br />required for a technical myisian The operator shall notice according to the standard <br />notice requirements for a permit amendment. If the Division receives a timely objection <br />to the application, the operator shall be notified and required to provide the remainder of <br />the standard fee for a permit amendment as soon as possible, but prior to the Division's <br />recommendation. If the required standard fee is not received by the Division's <br />recommendation date, the Division shall recommend that the application be denied. <br />_0 <br />This policy is not applicable and can not be used as a method to correct an existing or potential <br />violation. <br />C:\policy\acrexch.w +
