b) Will/does the applicant dispose of refuse in a manner that controls unsightliness or the <br />deleterious effects of such refuse? <br />Upon inspection of the site, it was noted that a dark material was on the ground near the product <br />stockpiles. It was also noticed that the dark substance had been mixed in with some of the mined <br />material. It was assumed that this was the material that Mr. Brent was referring to in his objection <br />letter. No other refuse was noticed on the site except for a small stockpile of concrete rip-rap that has <br />been noted on the site for many years. <br />The Lincoln County representative, Mr. Kenneth Morrison explained that the county hauls in ground <br />up asphalt, "Roto-Mill" to mix in with the mined material as a binding agent. This issue was <br />addressed in the inspection report and the adequacy review for this application. At this time, Lincoln <br />County has committed to discontinuing any mixing operation of material on site. They stated that all <br />traces of roto-milled material will be removed from the pit site. The applicant has also committed to <br />not storing debris of any kind on the site and removing any debris which is on the site currently, <br />including the concrete rip-rap pile. <br />Division Comment <br />The Division believes that the applicant has addressed the concerns of the objector. <br />B. THE FOLLOWING OBJECTIONS ARE NOT WITHIN THE JURISDICTION OF THE <br />DIVISION AND BOARD AND WAS RAISED DURING THE INITIAL APPLICATION <br />PUBLIC COMMENT PERIOD <br />"The original Pit was started in 1937 or 1938. For all of those years the material used was less <br />than what has been used in the last 10 years. It is a waste of material and county monies to haul <br />material from the pit to elevate dirt and gravel road when there is dirt and material within yards of <br />the elevation site". <br />2. "When the pit was permitted in 1978 I was assured it would never be expanded again. If this <br />expansion is granted what assurance do I have that a few years they won't expand it again until it <br />consumes 50A or more". <br />III. DIVISION RECOMMENDATION <br />It is the recommendation of the Office to approve the 112c permit conversion application for the Brent <br />Pit (M-1978-072) over the objection.
