The public comment period associated with these notices ended June 17, 2008. A <br />total of 14 timely comment or objection letters were received by the Division (of the 14 letters, <br />some were submitted by two or more parties jointly, therefore, a total of 22 individuals submitted <br />comments/objections). <br />The Division issued its Preliminary Adequacy Review letter to the Applicant on August 25, <br />2008. On September 9, 2008, the Division received a request for a waiver of the original 150- <br />day review timeframe, effectively setting the matter for the November 13, 2008 Board meeting. <br />The Applicant submitted its adequacy responses to the Division on September 17, 2008. The <br />Division issued its Rationale for Approval of the Application Over Objections on October 16, <br />2008. <br />The Pre-hearing Conference for this matter was held on October 23, 2008 at the Victor <br />Elks Club, 367 North 3rd Avenue, Victor, Colorado. Present at the Pre-Hearing Conference were <br />the following Parties: <br />• Cripple Creek and Victor Gold Mining Company and its representatives <br />• Citizens for Victor and its representatives <br />• Ms. Jo Ann Harris <br />• INFORM and its representative Jeff Parsons <br />• Sierra Club - Rocky Mountain Chapter and its representatives <br />All other persons previously deemed Parties by the Division based on timely submission of <br />objection letters did not attend the Pre-Hearing Conference and, therefore, lost their Party status <br />and all associated rights and privileges in accordance with Hard Rock Rule 2.7.3(4). <br />On November 6, 2008 the Division received withdrawal letters from Ms. Harris and Mr. <br />Collister. Although Mr. Collister appeared at the pre-hearing conference after it had concluded, <br />and therefore lost party status, the Division sought a formal letter from him to ensure his <br />concerns had been resolved. A letter of withdrawal was received by Jeff Parsons, on behalf of <br />his clients the Citizens for Victor, the Sierra Club, and INFORM, on November 9, 2008. Upon <br />receipt of this letter, all party objectors to this matter had formally withdrawn their objections. <br />Pursuant to Hard Rock Rule 2.7.3 (5), when all parties submit formal letters of withdrawal, the <br />Board directs the Office to act on the behalf of the Board and timely approve or deny the permit <br />application, therefore, the Division approved Amendment No. 9 with the conditions as agreed to <br />by the parties. <br />Please feel free to contact me with any questions that you may have regarding the final <br />outcome of this matter. The division issued its formal approval with conditions document on <br />Monday, November 10, 2008. A copy of the decision letter will be provided to those Board <br />members that would like to have a copy for their record.
