III. COMMENTS- COMPLIANCE <br /> Below are comments on the inspection. The comments include discussion of observations made during <br /> the inspection. Comments also describe any enforcement actions taken during the inspection and the <br /> facts or evidence supporting the enforcement action. <br /> This was a complete inspection conducted by Janet Binns of Colorado Division of Reclamation, Mining <br /> and Safety. Mr. John Weinman of Hydro-Environmental Solutions, Inc. accompanied the inspection as <br /> the permittee's representative. The site is an inactive load-out. The operation is approved to operate as a <br /> load-in facility too, but construction of off loading structures has not commenced. Weather was cool <br /> with intermittent rain showers. The site has received snow fall recently but no snow remained. Days <br /> have been above freezing. <br /> Records: Records for the Load Out were checked in the Hydro-Environmental office. Records are <br /> complete and well maintained. The Air Emissions permit had recently expired (8/23/2008). Since no <br /> loading or unloading activity is occurring on the site, the operator will wait until the operation is planned <br /> to reactivate prior to obtaining a new emission permit. This is acceptable with DRMS. <br /> HGTI has also recently received a renewed CPDS permit from CDPH&E. NPDES permit effective <br /> 7/l/2008. <br /> A new residence is under construction to the west of the county road alongside the rail line to the load <br /> out facilities. This residence is located several hundred feet west of the permit boundary. This is the <br /> first building in the zoned sub-development. <br /> Hydrologic Balance: Pond 1 (Truck loop pond) was holding a permanent pool of water. Water level <br /> was below the primary riser so no seepage was occurring at the time of the inspection. Mine personnel <br /> report that a small amount of seeping continues to occur at very low amounts. (<loz./minute in Oct) <br /> Pond 2 (Rail loop pond) was muddy but with no actual pool of water. The pond bottom was well <br /> vegetated. <br /> Culverts and ditches throughout the mine site are in good condition. No maintenance items were <br /> identified. <br /> Support facilities: The loadout facilities are inactive. Area stable and are clean of debris. The inactive <br /> hopper area at the truck loop has been covered with plywood to minimize unauthorized access. <br /> Reve eta The vegetation through out the site is adequate to control erosion. Temporary <br /> stabilization vegetation on the coal storage pad is effective in minimizing wind or water erosion. <br /> Vegetation on the site has dried down and is dormant for the winter. <br /> 3 of 5 WHITE-File YELLOW -Operator PINK-Specialist <br />
