III. COMMENTS - COMPLIANCE <br /> Below are comments on the inspection. The comments include discussion of observations made <br /> during the inspection. Comments also describe any enforcement actions taken during the inspection <br /> and the facts or evidence supporting the enforcement action. <br /> Backfill and Gradinq <br /> A substantial amount of rill and gully repair work was necessary this year, due to the heavy winter <br /> snowpack and associated runoff. Rills and gullies were concentrated primarily in the steep slope <br /> areas that were seeded in the last couple years, in the southern portion of the 016 watershed and <br /> lower portions of the 017 watershed. Erosion repairs were evident in various locations, including <br /> installation of minor diversions and dikes, minor regrading, and installation of TRM lined channels in <br /> certain locations where warranted due to concentrated flow. Although more detailed ground checking <br /> of erosional repairs will conducted by the Division, it appears that remedial work was implemented in <br /> accordance with Rill and Gully plan requirements. <br /> Two features were noted in the 017 watershed that warrant a closer check, along and adjacent to <br /> Channel PM-1 B. Black material (coal or carbonaceous overburden?) appeared to be exposed at the <br /> surface adjacent to the channel in an area approximately 10' by 30', immediately adjacent to the <br /> location where the TRM installation meets the riprap installation. Also, there appears to be an <br /> erosional feature or small seep/slide feature on the backfill outslope south of the channel along the <br /> disturbed area perimeter in the same general location. See photo attached. The operator will need <br /> to check these locations and repair as warranted. <br /> Revegetation <br /> As noted in the previous report, the fenced shrub plot in the 017 watershed, located downstream of <br /> the PM-1A/1B junction, straddling the PM-1 channel was planted in late September. Revegetation <br /> success is variable across the reclaimed landscape. Perennial grass cover is generally well <br /> established in the older, northern portions of the permit area, and watersheds in the "D" Pit and older <br /> portions of the "A" and "B" pit areas are generally well stabilized. More recently seeded areas, <br /> particularly on steep slope sites such as the upper slopes in the upper 016 watershed and lower <br /> portions of the 017 watershed are still subject to rill erosion due to relatively limited cover provided by <br /> establishing vegetation, but it would be anticipated that these slopes will stabilize over the next couple <br /> of growing seasons. <br /> 4 <br />
