Summary of Preliminary Adequacy Review for PR-14
Mine: West Elk
Permit No.: C-80-007
Date review completed: 9/18/08
DMG reviewer: Tom Kaldenbach
Require-

Requirements ments
complied
Comment
with? (yes/
no
Work proposed by PR-14 will be within the area added to the permit area in
previously approved in PR-10.
Right of entry No
(2.03.6(1)) ROE for the surface is provided by the FEIS titled"Deer Creek Shaft and E
Seam Methane Drainage Wells Project" whose ROD has become final.
Cultural resources surveys appear adequate based on their description in
Cultural resources
Yes the submittal and in the above-referenced FEIS. DRMS has not received a
(2.04.4) comment The letter from the SHPO dated 9/8/08 gave historical/cultural
resources clearance.
Fish/wildlife Fish and wildlife information appear adequate based on information in the
information (2.04.10, submittal (Habitat and Baseline Studies, July 2007) and in the above-
2.04.11, 2.05.6(2) Yes referenced FEIS. DBMS has not received a comment letter from the CDOW
and 4.18 or USFW.
Maps and plans Yes The submittal includes wellbore diagrams and a PE-certified map.
(2.10)
The proposed low volume roads meet the light-use road definition based on
their expected infrequent use of approximately 2 trips per day following
MDW construction (the same as MCC's previous MDW roads which are all
light-use roads). The PR-14 submittal provides a conceptual design that is
Light-use roads Yes adequate for the purpose of this PR. The proposed light-use roads meet the
(4.03.3) maximum grade limits of 4.03.3(3)(a), recognizing that adjoining, existing
FS roads and proposed new MDW pads comprise part of each proposed new
road segment. None of the new road segments ford an ephemeral stream
having a minimum drainage of onesquare mile.

Topsoil (4.06) and
topsoil markers Yes Page 8 of the submittal provides for topsoil stockpiling and marking.
(4.02.7)
Runoff from pads and roads can be expected to be alkaline with quality
Water quality Yes similar to pre-disturbance conditions. The runoff will be too alkaline to form
protection (4.05.2) leachates or to mobilize metals.
The mudpit for each drill pad will not be part of the sediment control
system for the pad. Each mudpit will be an impoundment (1.04(64)) that
will not have a spillway (4.05.9(2)(e) and will be located where failure
would not be expected to cause loss of life or serious property damage
Impoundments (4.05.9(2)(e). The submittal includes a safety factor demonstration for the
(4.05.9) No mudpits (Galena run using Simplified Bishop's method with a single circular
failure surface). A PE-certified mudpit design is in the submittal showing
the mudpits are sized to hold all of the cuttings from the boreholes and
expected surface runoff, with 1 ft. of freeboard, from a 25-yr., 24-hr. storm
4.05.9(2)(c)).
