Broken Arrow Investments, LLC Derr Pit, Adequacy Review Comment Responses, File No. M-2008-017 10117108
-8-
reservoir floor. The inlet/outlet pipe on the bottom of the wet well will also function as
an equalizer pipe to allow water into the wet well so when the discharge pump
station is operated water can be pumped/removed and discharged to the end users
system for use as augmentation water or perhaps raw water that could be treated
and used for potable water. Please refer to the revised Exhibit E and Exhibit F.
24. As required by Rule 6.4.5(2)(e), please provide a detailed time table for
reclamation. Include estimates for the amount of time to complete each phase
of reclamation, a description of the size and location of each area to be
reclaimed during each phase, and an outline of the sequence in which each
phase of reclamation will be carried out.
Response:
The time table to complete each phase of mining has been included in the revised
Exhibit E. We assumed the maximum production rate of 250,000 tons for processed
material leaving the mine each year. An average production rate of 150,000 tons per
year was used to calculate the reclamation time table. The size and area of
reclamation varies for each phase but generally consists of the outside mining slope
being reclaimed at a 3H:1 V slope with the addition of overburden, topsoil, and
revegetation. Please refer to the revised Exhibit E. For more information on
sequencing and size of the reclamation activities refer to Exhibit L financial warranty
calculations.
25. The applicant indicates that a surface use agreement is expected to be made
with the pertinent oil and gas companies regarding the existing well in the
middle of the affected area. Without an actual agreement in place, the
reclamation plan must reflect reclamation with the well and setback in place.
The reclamation plan map that was submitted could be used as an alternate
plan if an agreement to remove the well is reached. Please revise the
reclamation plan accordingly.
Response:
The reclamation plan map has been revised to show the existing oil/gas well
remaining. We are also submitting an altemate reclamation plan with the well
removed in the event that a final agreement may be in place before the decision
date. Please refer to the revised Exhibits E and F, and the altemate Exhibit F.
26. The reclamation plan map needs to include the well and setback, see
comments under Exhibit E.
Response:
The reclamation plan map has been revised to show the existing oil/gas well
remaining. We are also submitting an altemate reclamation plan with the well
removed in the event that a final agreement may be in place before the decision
date. Please refer to the revised Exhibits E and F, and the alternate Exhibit F.
27. As required by Rule 6.4.6(b), please show the final land use for each portion of
the affected lands; i.e., water storage, revegetated areas, and roads.
W4 t 1400 W 122' Avenue - Suite 120 • Westminster CO 80234 • Ph: 303-457-0735 • Fax: 303-920-0343
