Broken Arrow Investments, LLC believes that the mining operation, as proposed, will
not adversely affect any of the permanent, man-made structures located within 200 ft of
the affected area. However, the applicant still anticipates providing evidence of
agreements for compensation with the appropriate structure owners or engineering
evaluations (see attached slope stability report) that adequately demonstrate that the
proposed mining and reclamation operations will not result in damage to the structures.
