Broken Arrow Investments, LLC Derr Pit, Adequacy Review Comment Responses, File No. M-2008-017 10117108 <br />-2- <br />exposed. Broken Arrow Investments, LLC will provide a temporary substitute water <br />supply plan (SWSP) to the Division of Water Resources for approval and then apply <br />for a gravel pit well permit once the SWSP is approved. The SWSP and gravel pit <br />well permit will be in place prior to exposing groundwater. <br />2. As required by Rule 1.6.2(1)(b), please provide a signed affidavit stating that <br />the applicant has posted notice at the location of the mine site. <br />Response: <br />The signed affidavit was submitted previously with our application and we have also <br />attached a copy with this letter. <br />3. The location of the main entrance to the mine was not included in the legal <br />description. Please provide the coordinates of the mine entrance in <br />accordance with Rule 6.3.1(2). The coordinates should be in latitude and <br />longitude in degrees, minutes, and seconds or in decimal degrees to an <br />accuracy of at least five decimal places. The mine entrance can also be given <br />in UTM, along with associated North American Datum. <br />Response: <br />Exhibit A has been revised to include the coordinates of the mine entrance with the <br />legal description. Please refer to the revised Exhibit A. The coordinates are as <br />follows: <br />Latitude (N) 40.43012 <br />Longitude (VI/) -104.66840 <br />4. 'The mining plan map lists the adjoining surface owners of record, but does not <br />indicate the location of each of the surface owners of record. Please revise the <br />map to include this information. <br />Response: <br />The mining plan map has been revised to indicate the location of each of the surface <br />owners of record. Please refer to the revised Exhibit C. <br />5. The mining plan map indicates that the recharge pond is within the permit <br />boundary, but is outside of the mining limit or affected acreage. The recharge <br />pond must be included with the affected acreage. Please amend the affected <br />acreage to include the recharge pond. If you choose to increase the affected <br />acreage, you will need to submit an amendment to the application. You may <br />also choose to relocate the recharge pond within the existing affected acreage <br />via a technical revision rather than amendment. Please refer to Rule 1.9 and <br />Rule 1.10 for procedures on submitting a technical revision or amendment. <br />Response: <br />Per our phone conversation on October 10, 2008 the recharge pond will remain in its <br />current location as it was accounted for and is within the mining permit <br />boundary/affected acreage. <br />6. The mining plan map does not include the type of present vegetation covering <br />the land.
