CMC appreciates the thorough review <br /> received by the Division and the ensuing discussions of April 29. The following <br /> information serves as a point by point response to the Division's review of issues related <br /> to Amendment AM-003. An updated map, legal description, a 3-Dam borrow area <br /> reclamation outline, and an amended cost summary table are included as attachments. <br /> 1. CMC concurs with the Division that the currently permitted affected land acreage for <br /> the Climax Mine is 3372 acres (Amendment AM-002, 1989). The discrepancy noted in <br /> the Amendment application document for AM-003 reflects a change in mapping <br /> techniques used to assess actual affected land for the property. The 1989 use of <br /> planimetry techniques to outline affected lands have been replaced by Geographical <br /> Information System (GIS) database measurements that are much more accurate. <br /> Several iterations of the base map were made in the application preparation resulting in <br /> the identification of 3467 and 3475 acres of affected land in separate sections of the <br /> application document. The final map, submitted with this letter, identifies 3471 acres of <br /> affected land within the 1989 boundaries. <br /> 2. CMC agrees with the Division that the 1977 legal description for the Climax Mine is <br /> more accurately portrayed by the 1980 description provided in Amendment AM-001. <br /> Attached is a legal description for the Climax Mine property boundary by reference to <br /> township, range, and section to the nearest quarter quarter section. This property <br /> boundary is shown on the enclosed map. <br /> 3. Interceptor canals associated with the water treatment system have been included in <br /> the affected land areas for the Climax Mine. CMC concurs with the items i) and iii) of the <br /> rationale set forth in the adequacy response. Item ii) will be addressed in future <br /> discussions related to the approval of the Climax Mine Environmental Protection Plan. <br />
