The Climax Molybdenum, Company (CMC) has completed review and evaluation of the
Division of Minerals and Geology's (Division) April 20, 1997 adequacy review for the
Amendment application, Amendment AM-003. CMC appreciates the thorough review
received by the Division and the ensuing discussions of April 29. The following
information serves as a point by point response to the Division's review of issues related
to Amendment AM-003. An updated map, legal description, a 3-Dam borrow area
reclamation outline, and an amended cost summary table are included as attachments.
1. CMC concurs with the Division that the currently permitted affected land acreage for
the Climax Mine is 3372 acres (Amendment AM-002, 1989). The discrepancy noted in
the Amendment application document for AM-003 reflects a change in mapping
techniques used to assess actual affected land for the property. The 1989 use of
planimetry techniques to outline affected lands have been replaced by Geographical
Information System (GIS) database measurements that are much more accurate.
Several iterations of the base map were made in the application preparation resulting in
the identification of 3467 and 3475 acres of affected land in separate sections of the
application document. The final map, submitted with this letter, identifies 3471 acres of
affected land within the 1989 boundaries.
2. CMC agrees with the Division that the 1977 legal description for the Climax Mine is
more accurately portrayed by the 1980 description provided in Amendment AM-001.
Attached is a legal description for the Climax Mine property boundary by reference to
township, range, and section to the nearest quarter quarter section. This property
boundary is shown on the enclosed map.
3. Interceptor canals associated with the water treatment system have been included in
the affected land areas for the Climax Mine. CMC concurs with the items i) and iii) of the
rationale set forth in the adequacy response. Item ii) will be addressed in future
discussions related to the approval of the Climax Mine Environmental Protection Plan.
