The <br /> Division will apply a condition to the eventual approval of amendment <br /> AM-003 that requires submittal of the additional bond within 60 days of <br /> the approval date or prior to disturbance in the amended area of <br /> affected land, whichever date is sooner. <br /> 3 . The 3-Dam Borrow Area Reclamation Plan provided with the CMC <br /> letter dated May 27, 1997 specifies maximum reclaimed slope <br /> configurations of 2H: 1V. The plan further states that the borrow areas <br /> will be regraded to a configuration that approximates original contour. <br /> The existing topography of the proposed borrow areas, as shown on the <br /> map submitted with the CMC May 27, 1997 letter, is relatively gentle <br /> with no slopes as steep as 2H: 1V, and most areas much less steep than <br /> 2H: 1V. Please note that Rule 6 .3 .4 (1) (b) requires that applicants <br /> proposing regraded slopes steeper than 3H: 1V provide justification that <br /> supports steeper slopes for the proposed post-mining land use, and <br /> demonstrates compliance with the applicable performance standards of <br /> Rule 3 . 1. Please note that Rule 6 . 3 .4 (1) (b) applies only to 110 type <br /> reclamation permits, however, the Division applies the criteria of the <br /> rule, as a matter of policy, to other permits as well, such as the 112D <br /> type reclamation permit held by CMC for the Climax Mine. Please either <br /> commit to maximum reclaimed slopes of 3H:1V for the 3-Dam borrow pits <br /> or provide justification for reclaimed slopes that are steeper than <br /> 3H:1V. <br /> The Division currently considers the type of information requested in <br /> this letter to be for the purpose of detailing, clarifying or <br /> explaining the amendment AM-003 application (see Rule 1 . 8 . 1 (4) ) . As <br /> such, this letter and CMC' s responses do not have to be filed with the <br /> Summit, Lake, and Eagle County Clerks. Depending on the nature of the <br /> final resolution of the issues listed above, the Division reserves the <br /> right to require additional filings with the County Clerks if it is <br /> determined that changes to the application constitute an amendment or <br /> a technical revision to the application (see Rule 1 . 8 . 1 (1) ) . <br /> If you have any questions, please contact me. <br /> Sincerely, <br /> Allen C.
